These Terms of Use ("Terms") govern access to and use of the website brighthipsdrain.pro and the purchase of workspace ergonomics analysis products and services offered by Brighthipsdrain. By using our website or purchasing our products, you agree to these Terms. If you do not agree, do not use the site or services.
1. Definitions
"Products" means ergonomics assessment kits listed on ergo-kits.html, including Desk Snapshot Assessment, Full Workspace Ergonomics Report, and Team Posture Workshop Kit. "Services" means on-site, virtual, and consultancy offerings described on posture-lab.html. "You" means the individual or organisation using our website or purchasing Products or Services.
2. Eligibility
You must be at least eighteen years old and capable of entering a binding contract under New Zealand law. Organisations must ensure authorised representatives accept these Terms on their behalf.
3. Website Use
You agree to use brighthipsdrain.pro only for lawful purposes. You must not:
- Attempt unauthorised access to our systems or data;
- Transmit malware, spam, or harmful code;
- Scrape content in a manner that burdens our infrastructure;
- Misrepresent your identity or affiliation;

Product descriptions, pricing in NZD, and deliverables are summarised on our website. Detailed scope is confirmed at booking. We may update offerings, pricing, or availability with reasonable notice where you have an active order affected.
Ergonomics guidance is educational and advisory in nature. Outcomes depend on implementation, equipment quality, and individual factors. We do not guarantee specific comfort results but commit to professional, good-faith analysis.
5. Orders and Payment
Orders are confirmed when we acknowledge payment or send written confirmation. Prices include GST where stated. You are responsible for accurate contact and billing information. Failed payments may delay delivery of assessment reports or workshop scheduling.
6. Scheduling and Access
On-site visits require safe access to your premises and reasonable cooperation. Virtual sessions require stable internet and timely submission of photos or videos. Rescheduling is subject to our Return Policy and mutual availability.
7. Intellectual Property
Website content, branding, methodologies, report templates, and training materials are owned by Brighthipsdrain or licensors. You receive a personal or internal business licence to use delivered reports for your own workspace improvement. Redistribution, public publication, or commercial reuse requires prior written consent.
8. Your Content
You retain ownership of workspace photos and information you submit. You grant us a licence to use that content solely to deliver Products and Services, improve our methodologies internally, and comply with law. See our Privacy Policy for data handling details.
9. Disclaimers
To the fullest extent permitted by law, the website and deliverables are provided "as is" without warranties of uninterrupted access or error-free operation. We disclaim implied warranties where allowable. Nothing in these Terms excludes rights you cannot waive under the Consumer Guarantees Act 1993 or other mandatory New Zealand law.
10. Limitation of Liability
Our total liability for any claim arising from Products or Services is limited to the amount you paid for the relevant order in the twelve months preceding the claim, except where liability cannot be limited by law. We are not liable for indirect, consequential, or lost-profit damages arising from desk setup decisions you make independently.
11. Indemnity
You agree to indemnify Brighthipsdrain against claims arising from your misuse of the website, breach of these Terms, or submission of unlawful content, except to the extent caused by our negligence or wilful misconduct.
12. Termination
